DLG provides assessments of all available and viable options, representation in complex bankruptcy and other debtor/creditor proceedings, and strong legal counsel in any type of commercial litigation matter.
Mission
DelCotto Law Group’s mission is to provide focused legal service in all debtor/creditor-related situations, with a concentration in debt restructuring, bankruptcy proceedings, and commercial disputes that lead to litigation, while following the Firm’s philosophies. These services include out-of-court workouts, state court litigation, formal bankruptcy proceedings, bankruptcy sales and transactions, and the representation of bankruptcy committees, trustees, examiners, and adversary proceeding parties. The Firm prides itself on its accessibility and responsiveness to clients’ particular needs and recognizes that there may be more than one solution to every problem. DLG makes every effort to explore with its clients what the options are before merely jumping in to some course of action without thorough analysis of the pros and cons of each option.
Qualifications
Founding Member Laura Day DelCotto is a Fellow in the American College of Bankruptcy—an honor bestowed on only a few bankruptcy and insolvency professionals based on the highest professional qualifications and ethical standards, character, integrity, leadership, and a proven record of the highest standards of service to the insolvency profession. Ms. DelCotto is certified in Business Bankruptcy Law by the American Board of Certification, a long-time member of the American Bankruptcy Institute and “AV” rated by Martindale-Hubbell. Together with the DLG team of attorneys and paraprofessionals, the Firm prides itself on its close attention to detail and takes a results-oriented and hands-on approach to each engagement it accepts. With DLG’s assistance, many businesses and individuals have resolved financial crises.
DLG’s senior attorney team, consisting of Ms. DelCotto, Dean Langdon and Michael Gartland, are each former practitioners at “big law” firms. With over 20 years experience each, they are well versed in most matters that come in to the Firm. Having several paraprofessionals who each have 20 plus years in legal experience, as well as excellent junior members on each of the attorney and paraprofessional teams, makes DLG a well-rounded firm that is able to quickly and efficiently handle all matters. DLG represents clients in federal and bankruptcy courts in both the Eastern and Western Districts of Kentucky, as well as in bankruptcy courts in other jurisdictions and state courts throughout the Commonwealth.
Firm Philosophy
DLG’s philosophy is driven off of several key concepts, the most important of which are summarized as “no surprises” and “making a difference.” The DLG team is a true team, not a group of people from a national, multi- office law firm who may barely know each other. The professionals and paraprofessionals at DLG realize that many of their clients find themselves in extremely stressful and difficult circumstances where they never thought they would be. Time is almost always “of the essence” in DLG engagements, as time means money. DLG strives to never have a surprised client or a surprise within its teams, always looking ahead to possible reactions and actions of other parties in interest. The DLG teams work hard to educate clients about the options available to them and the way each option might play out, noting that some things are outside of the client’s control.
In addition to hating surprises, the DLG team truly and deeply feels it is making a difference in the lives of its clients. Financial “life or death” is often on the line. DLG team members strive to provide calm and guiding influence and counsel through very difficult times. Desired outcomes are not always feasible, but DLG will work through each unique situation as best as it can for the benefit of each of its clients and to try to maximize bad situations for all involved. DLG believes that its concentration in the field of debt restructuring provides cost-effective results that cannot be provided by a large, full-service law firm. Each case is handled with a view toward avoiding expensive protracted litigation and exploring all alternative dispute resolution avenues, but being ready to go to court if necessary. DelCotto Law Group treats each client’s debt structure as unique and fashions legal strategies to meet the client’s specific goals. The Firm does little to no work for traditional secured lender banks so that it can remain free of potential disqualifying conflicts of interest or limited engagements, and can quickly jump in to represent borrowers and committees when speed is needed.
DelCotto Law Group practices in a historic 200 year old building, The Abraham Barton House, located in the heart of Gratz Park in downtown Lexington. It takes pride in carrying on the traditions of its Blue Grass Trust and National Historic Register location.
